Welcome to KT Solar! The terms “we”, “us” and “our” refer to KT Solar. We operate this store and website, including all related information, content, features, tools, products and services to provide you with a curated shopping experience (the “Services”). KT Solar is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced here (including our Privacy Policy), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Your rights: Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

1. ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state or territory of residence and, where applicable, you consent to any minor dependents using the Services on devices you own or manage.

To use the Services (including browsing or purchasing), we may ask for information such as your email, billing, payment and shipping details. You warrant this information is correct, current and complete and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer or sell your account.

2. OUR PRODUCTS

We aim to describe products accurately, but colours and appearance can vary due to your device and settings. We do not warrant that any product will meet your individual expectations or exactly match on-screen representations. Product descriptions, pricing and availability may change at any time without notice. We may discontinue products or limit quantities to any person, region or jurisdiction.

3. ORDERS

When you place an order you make an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is accepted when we confirm acceptance and process your payment. Please review your order carefully; we may be unable to accommodate cancellation requests after acceptance. If we do not accept, change, or cancel an order, we’ll attempt to notify you using the contact details provided at checkout.

Your purchases are subject to our Refunds & Returns Policy (link). You represent that your purchases are for personal/household use and not for resale or export.

4. PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged is the price in effect when you place the order and appears in your confirmation email. Unless expressly stated, prices exclude taxes, shipping, handling and any customs/import charges.

You agree to provide current, complete and accurate purchase and account information, and to promptly update details (including email and payment method expiry dates) so we can complete transactions and contact you as needed. You warrant that you are authorised to use the nominated payment method and will pay all charges, including applicable taxes, shipping and handling.

5. SHIPPING AND DELIVERY

Delivery estimates are indicative only and not guaranteed. We are not responsible for carrier delays, customs processing or events outside our control. Risk of loss passes to you when the order is delivered to the address you provide, except as required under the ACL.

6. INTELLECTUAL PROPERTY

All trademarks, brands, text, images, graphics, video, audio and their selection and arrangement on the Services are owned by KT Solar, our affiliates or licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. You must not copy, modify, distribute, display, perform, publish, or create derivative works without prior written consent. KT Solar names, logos and slogans are our trademarks. Shopify’s names and marks are trademarks of Shopify. All other marks are the property of their owners.

7. OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsement. Your use of such tools is at your own discretion and subject to the third party’s terms.

8. THIRD-PARTY LINKS

The Services may contain links to third-party websites or materials. We are not responsible for, and have no liability arising from, third-party content, products or services. Review third-party policies before engaging in any transaction. Direct any questions or complaints to the relevant third party.

9. RELATIONSHIP WITH SHOPIFY

KT Solar is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with KT Solar. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KT Solar, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with KT Solar.

10. PRIVACY

Personal information we collect is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information to provide and improve the Services. If you submit reviews, ideas or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish and display the Feedback for any purpose. 12. ERRORS, INACCURACIES AND OMISSIONS

From time to time there may be typographical errors or inaccuracies relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct and update such information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

Except as required by law (including the ACL) or expressly stated by us, the Services and all products are provided “as is” and “as available.” We do not guarantee uninterrupted, timely, secure or error-free use. Some rights and remedies under the ACL cannot be excluded; this clause applies only to the extent permitted by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, KT Solar and our officers, employees, agents, contractors, service providers and licensors will not be liable for indirect or consequential loss (including loss of profit, revenue, savings or data) arising from your use of the Services or products, except where liability cannot be excluded under the ACL. Nothing limits liability for products with safety issues or for personal injury or death caused by our negligence where such limitation would be unlawful.

17. INDEMNIFICATION

You agree to indemnify and hold harmless KT Solar and our related parties (and Shopify and its affiliates) from losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.

18. SEVERABILITY

If any provision is unlawful or unenforceable, it will be severed and the remaining provisions will continue in full force to the extent permitted by law.

19. WAIVER; ENTIRE AGREEMENT

A failure to enforce any provision is not a waiver. These Terms and any policies posted on the Services constitute the entire agreement between you and us regarding the Services and supersede prior agreements.

20. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without notice.

21. GOVERNING LAW

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

Headings are for convenience only and do not affect interpretation.

We may update these Terms from time to time by posting the revised version on this page. We’ll notify you of material changes as required by law. Your continued use of the Services after changes take effect constitutes acceptance.
